What is Trademark Registration?

Trademark registration refers to the process by which an individual, proprietorship, company, or other legal entity registers a trademark with the Trademark Registry. Once a trademark application is filed, the applicant can begin using the ‘TM’ symbol within a few days. The Trademark Registry typically takes around 4 to 6 months to complete the registration process.

Upon successful registration and issuance of the certificate, the ® symbol may be used. A registered trademark is valid for 10 years from the date of filing and can be renewed indefinitely upon expiry.

Trademark Symbols in India

In India, the following trademark symbols are used:

TM Symbol

TM Symbol (™)

Brands use the (™) symbol after they have filed their trademark application, and the application is still in the process. Businesses can use this symbol for both goods and services. It functions as a warning sign for infringers.

R Symbol

R Symbol (®)

The (®) symbol indicates that the trademark is officially registered with the Trademark Office. The owners of trademarks have the right to sue those who copy their trademark.

SM Symbol

SM Symbol (℠)

The (℠) symbol is utilized for service marks that are not registered with the Trade Marks Registry. Like the ™ mark, it identifies and sets the service apart.

Types of Trademarks in India

In India, the following major types of trademarks exist:

Product Mark

A product mark is one that is applied to a good or product as opposed to a service. This kind of trademark helps in preserving a company's reputation and is used to identify the product's place of origin.

Certification Mark

A certification mark is a symbol used to indicate a product’s origin, composition, quality, or other specified characteristics, granted by the mark’s owner. Its primary objective is to reflect the product's standard and offer assurance of quality to consumers.

Service Mark

Similar to a product mark, a service mark is used to identify a service as opposed to a product. The service mark's primary function is to set its owners apart from those of other services.

Collective Mark

A collective mark, in trademark law, refers to a sign used by members of a group or association to signify their affiliation and to differentiate their products or services from those of individuals outside the group. The owner of such a mark can be a Section 8 company, an association, or a public body.

Sound Mark

A sound mark is a unique audio signature that becomes associated with a product or service provided by a particular source. To register a sound mark, it must be recognizable enough for the public to connect the sound directly to the product, service or brand.

Shape Mark

A shape mark is designed to protect a product's distinctive shape and allows the consumers to associate the shape with a particular manufacturer. It influences the purchasing decisions of consumers.

Pattern Mark

Pattern marks refer to trademarks that consist of specific and identifiable designs or patterns that serve to differentiate a product. If a pattern lacks uniqueness and fails to create a strong impression, it is usually not approved for registration.
